How to write a dismissal letter
While this is never going to be an easy thing to do, you have to write this letter if you see that the employee is unfit to work for you and the company. So, here are the steps that should help you prepare and write a proper dismissal letter:
Preparing to write the letter
Go through the employment contract. If the employee is under a contract, then you cannot just fire this person whenever you see fit. It is standard for a contract to state that an employee will only be terminated if there is a good reason to do it or if it is a just cause. So, you should go through your company’s employment contract to see all of the circumstances in which you are allowed to fire an employee.
- There is a chance that the employee may also be covered by a collective bargaining agreement sample. If that is the case, then locate a copy and go over the grounds that cover the termination provisions. This usually lays out a process that you have to follow before you can terminate an employee
- There are times where an employee can claim that an “implied contract” was created during the entire working relationship. If one indeed exists, then you can terminate the employee for “good cause”. The court will look into all of the factors that will contribute to an implied contract. This would include the employee’s duration of employment, promotions gained, industry practices, and documents which promise the employee an assurance of continued employment.
Gather the evidence on the grounds of terminating the employee. Make sure that you have all the evidence you need to show that you have all the right to terminate the employee.
- Make sure that you thoroughly sample investigate the employee’s performance. Just because the employee’s supervisor said that the employee is not exactly doing a good job, it does not mean that you have to take his word for it. Go through the employee’s records and review everything that shows how he is performing in the company.
- Identify a valid reason for termination. As stated before, you cannot just a fire an employee because you feel like it, you have to be specific as to why you the employee has to be let go. This will help protect you from getting sued by a dismissed employee.
Seek the advice of a lawyer. Depending on your country or state, there will be laws on the grounds by which you can terminate an employee. To make sure that you follow these laws, always consult with a lawyer to help you out.
