Steps on How to File a Complaint?
Step 1: Filing the Complaint
Any person, public agency, or association may file a formal complaint claiming the school’s failure to comply. Complaints can be made using the standard form provided at the school site or office. Complaints could be anonymous. If the claimant demands an answer and offers contact information, the school shall provide a written response to the complainant’s mailing address specified on the complaint. If a student is unable to file a complaint in writing due to conditions such as analphabetism or other handicaps, school staff must support him/her in making the complaint.
Step 2: Intervention of Complaint
After three business days following receipt of the complaint, the compliance officer may informally discuss the possibility of using intervention with the complainant. All preparations for this procedure shall be made by the compliance officer where the parties agree to mediate. The compliance officer must ensure that all parties agree to make the mediator a party to relevant confidential data before beginning the settlement of a complaint involving discrimination, abuse, coercion or bullying. The Compliance Officer shall precede his / her investigation of the complaint If the mediation process does not resolve the problem within the parameters of the law. Unless the complaint is resolved, the use of mediation shall not extend the timelines of the school for investigation and resolution.
Step 3: Inspection of the Complaint
The compliance officer must provide the complainant or his/her representative an opportunity to provide the complaint and any evidence, or information that leads to evidence, to support allegations in the complaint. The compliance officer must also collect all documents and interview all the witnesses with the information relevant to the complaint. In case the complainant refuses to provide documents or other evidence related to the allegations in the complaint or fails to cooperate in the investigation, it may result in the discharge of the complaint because of a lack of evidence.
Step 4: Response
The compliance officer must prepare and send a written report to the school’s investigation and decision, as described above. This report must be sent within 60 calendar days of the school receipt of the complaint.
Step 5: Final Written Conclusion
The recommendation of the school is to be sent to the student in person. The opinion of the school shall be written in the plaintiff’s English and language wherever possible or as required by law.
The recommendation shall include points like the factual findings that are based on the evidence obtained, the conclusions of law, the character of the complaint, the reasons for such arrangement, corrective measures are taken if any is warranted, etc.
How Can You File a Uniform Complaint Policy?
The uniform complaint policies and procedures provide the information that is required to file a local complaint. The students, employees, parents or guardians and the other parties must be annually notified of the complaint policies and procedures. They must also be notified about the opportunity to appeal the decision of the head and this information must be provided free of charge.
What Topics Are Not Covered by the Uniform Complaint Policy?
There are some types of complaints that cannot fall under the scope of the uniform complaint policy. The local education authority is mainly responsible for many concerns like classroom assignments, common core, grades, graduation requirements, hiring, and other general education requirements. This authority may even use its local complaint to address the complaints that are not covered by the uniform complaint policy. Complaints that are referred to other agencies for resolution and are not subject to the UCP are allegations of child abuse, health and safety complaints, employment complaints, etc.
