SALES ONBOARDING AGREEMENT FOR REMOTE SALESPERSONS

This Agreement ("Contract") is entered into this [Month Day, Year], between [Your Company Name], a corporation duly incorporated under the laws of [State/Country], having its principal place of business at [Your Company Address], hereinafter referred to as the "Company", and [Salesperson's Name], an individual residing at [Salesperson’s Address], hereinafter referred to as the "Salesperson";

WHEREAS, the Company is engaged in the business of software sales, and wishes to employ the Salesperson for its remote sales operations;

AND WHEREAS, the Salesperson possesses skills, experience, and expertise in sales and is interested in a remote sales position with the Company;

NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:

Purpose of Agreement

This Agreement comprehensively sets forth the terms and conditions under which the Salesperson shall be employed by the Company for the purpose of engaging in remote sales activities. This contractual arrangement aims to define the scope of work, responsibilities, obligations, and rights of both the Company and the Salesperson. 

  1. The Salesperson is expected to perform duties related to sales functions remotely, in a manner consistent with the Company's policies, procedures, and performance expectations. Likewise, the Company agrees to provide the Salesperson with the necessary tools, compensation, and support required to perform their duties effectively. 

  1. By entering into this Agreement, both parties acknowledge and consent to the stipulated terms and conditions, recognizing that adherence to this Agreement is crucial for the mutual benefit and success of both the Company and the Salesperson. 

  1. This Agreement shall serve as the exclusive basis for the employment relationship between the parties, superseding all previous communications, proposals, or agreements, either oral or written, unless expressly stated otherwise herein.

Terms of Employment

  1. Position

    The Salesperson shall be hired in the capacity of a remote salesperson, reporting directly to [Immediate Supervisor’s Name/Title]. In this role, the Salesperson will be responsible for executing sales strategies, initiating contact with potential clients, and meeting sales targets as may be assigned by the Company. The Salesperson is expected to collaborate with other departments to ensure a cohesive and effective sales approach.

  1. Compensation
    The Salesperson will be compensated as outlined in Addendum A, attached hereto. This addendum will detail the Salesperson's base salary, any potential commissions, bonuses, and other financial incentives that may be applicable. Both parties agree that the compensation structure may be reviewed and revised periodically based on performance metrics and market standards.

  1. Work Hours
    The Salesperson will adhere to a flexible work schedule, as mutually agreed upon by the Salesperson and the Company. While the nature of remote work allows for a certain degree of flexibility, the Salesperson is expected to be available during key business hours to attend meetings, respond to client queries, and perform other job-related tasks. The specific details of the work schedule shall be discussed and agreed upon, and may be subject to change based on the needs of the Company.

Roles and Responsibilities

  1. Duties of Salesperson
    The Salesperson shall perform a variety of tasks, including but not limited to customer outreach through cold calls, emails, or social media, delivering compelling sales presentations to potential clients, and closing deals to meet revenue objectives. The Salesperson is also responsible for managing client relationships, following up on leads, and working closely with the sales team to develop and implement effective sales strategies.

  1. Performance Metrics
    The Salesperson is expected to meet or exceed sales targets as set forth by the Company on a monthly, quarterly, or annual basis, depending on the metric time frame defined. These targets will serve as a key performance indicator (KPI) for the Salesperson and will be closely monitored by the Company to evaluate the effectiveness and success of the sales strategies in place.

  1. Reporting
    The Salesperson is required to regularly report on sales activities, customer interactions, and performance metrics to the Company through [Platform/Method], such as a weekly sales report or a specialized software dashboard. This regular reporting is essential for keeping the Company informed of sales progress and will be used in performance reviews to identify areas for improvement or commendation.

Equipment and Resources

The Company shall furnish the Salesperson with all the necessary tools and equipment required for performing their duties effectively in a remote work environment. This includes, but is not limited to, providing software licenses for sales management and customer relationship management (CRM) tools, company-branded merchandise or materials needed for presentations, and other digital resources like access to company databases or platforms.

Termination

Either party reserves the right to terminate this Agreement unilaterally by providing written notice to the other party. Such written notice shall be delivered no less than thirty (30) days prior to the intended date of termination. Upon receiving the notice, both parties shall make all reasonable efforts to fulfill their remaining obligations up until the termination date specified in the notice. All clauses in this Agreement that by their nature should survive termination, including confidentiality, non-compete, and intellectual property clauses, shall remain in effect beyond the termination of this Agreement.

Confidentiality

Both parties hereby acknowledge and agree that during the course of this Agreement, they may be exposed to or acquire information that is confidential to the other party. Any breach of this confidentiality clause may result in immediate termination of this Agreement and could give rise to legal proceedings for injunctive relief and/or damages. Both parties further agree to take all reasonable precautions to prevent any unauthorized use, disclosure, publication, or dissemination of Confidential Information, and to comply with all applicable laws and regulations in their handling of such information.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of [State, e.g., "California"], without regard to its conflict of laws principles. In the event of any dispute, claim, question, or disagreement arising from or relating to this Agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement through good-faith negotiations. If such efforts prove unsuccessful, either party may initiate an arbitration proceeding in accordance with the rules of an arbitration body mutually agreed upon by the parties.

Amendments

Any amendments, modifications, or changes to this Agreement must be made in writing and must be signed and acknowledged by both parties to be effective. No oral representation or statement shall serve to amend or modify this Agreement unless subsequently confirmed in a written amendment signed by both parties. Such amendments shall be appended to this Agreement and shall be subject to the same terms and conditions set forth herein, unless otherwise stated in the amendment.
