Article I: Name and Purpose

1.1 Name: The name of this corporation shall be [Name of Strata Corporation].

1.2 Purpose: The purpose of these bylaws is to establish rules and regulations for the maintenance and use of the property owned by the strata corporation, to provide mechanisms for resolving disputes among strata members, and to ensure compliance with all relevant regulations and standards.

Article II: Definitions

2.1 "Strata Corporation" refers to the collective ownership entity comprised of all owners of strata lots within the property.

2.2 "Strata Lot" refers to a portion of the property shown on the strata plan.

2.3 "Owner" refers to any individual or entity holding legal title to a strata lot within the property.

Article III: Property Maintenance

3.1 Exterior Maintenance: Owners are responsible for the maintenance and repair of the exterior of their strata lots, including but not limited to windows, doors, and balconies.

3.2 Common Areas Maintenance: The strata corporation shall be responsible for the maintenance and repair of common areas, including but not limited to hallways, stairwells, and parking lots.

3.3 Maintenance Fund: Owners shall contribute to a maintenance fund, established by the strata council, to cover the costs of ongoing maintenance and repairs.

Article IV: Use of Property

4.1 Use Restrictions: Owners shall not use their strata lots or common areas for any unlawful or commercial purposes.

4.2 Noise and Nuisance: Owners shall not create excessive noise or engage in activities that constitute a nuisance to other strata members.

4.3 Alterations: Owners must obtain approval from the strata council before making any alterations to the exterior of their strata lots.

Article V: Dispute Resolution

5.1 Internal Disputes: In a dispute between strata members, parties shall attempt to resolve the issue informally. Mediation or arbitration may be pursued if resolution cannot be achieved as outlined in the Strata Property Act.

5.2 Strata Council Decisions: Decisions made by the strata council regarding property maintenance, use, or other matters shall be considered final unless successfully challenged through the dispute resolution process.

Article VI: Compliance with Regulations

6.1 Regulatory Compliance: Owners shall comply with all municipal bylaws, zoning regulations, and other applicable laws governing the use and maintenance of the property.

6.2 Insurance Requirements: Owners must maintain insurance coverage for their strata lots as required by the Strata Property Act.

6.3 Enforcement: The strata council may take enforcement action against owners who fail to comply with these bylaws, including fines or legal action if necessary.

Article VII: Amendments

7.1 Amendment Procedure: These bylaws may be amended by a special resolution passed at a general meeting of strata members, provided that notice of the proposed amendment is given following the Strata Property Act.

7.2 Registrar Approval: Any amendments to these bylaws must be filed with the Registrar of Land Titles following the requirements of the Strata Property Act.
