BIOMETRIC DATA PRIVACY AGREEMENT HR

1. Purpose

This Agreement is designed to inform and protect the privacy rights of Employee concerning the collection, use, and retention of Employee's biometric data by the Company.

2. Definitions

1. Biometric Data: Refers to unique biological or behavioral characteristics, including but not limited to fingerprints, facial recognition data, iris scans, and hand geometry, that can be used to identify an individual.

2. Biometric Data Collection: The process of gathering and storing biometric data.

3. Consent

Employee hereby consents to the collection, storage, and use of their biometric data by the Company for the following purposes:

• Access Control: Employee's biometric data will be used for access control purposes, including but not limited to granting or denying physical and digital access to Company facilities and systems.

• Time and Attendance Tracking: Employee's biometric data will be utilized for time and attendance tracking, ensuring accurate recording of work hours and attendance records.

• Security Purposes: Biometric data will enhance security measures within the Company, helping to safeguard against unauthorized access and ensuring the safety of employees, facilities, and assets.

4. Data Security

The Company will implement reasonable security measures to protect Employee's biometric data, including but not limited to encryption, access controls, and regular security assessments.

5. Data Retention

Employee's biometric data will be retained for the duration of their employment with the Company. Upon termination of employment or upon Employee's request, the Company will securely delete or destroy all biometric data within a reasonable timeframe.

6. Disclosure

The Company will not disclose Employee's biometric data to any third party without Employee's explicit consent, except as required by law.

7. Employee Rights

1. Employee has the right to review and request corrections to their biometric data.

2. Employee may revoke their consent for biometric data collection at any time, in writing, subject to any legal or contractual obligations.
   

8. Legal Compliance

This Agreement is subject to all applicable federal, state, and local laws and regulations, including but not limited to the Illinois Biometric Information Privacy Act (BIPA) and the requirements under the Fair Labor Standards Act (FLSA).
