Real Estate Liability Waiver Rental Agreement

This Rental Agreement ("Agreement") is made and entered into on [Date], between:

Landlord:

Tenant:

A. Property Address:

C. Rental Payment:

D. Real Estate Liability Waiver:

In consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

  1. Release of Liability: The Tenant hereby releases, waives, discharges, and covenants not to sue the Landlord, its officers, directors, employees, agents, and representatives (collectively, the "Released Parties"), from and against any and all claims, demands, liabilities, losses, damages, and expenses (including attorney's fees) arising out of or in any way related to the Tenant's use or occupancy of the Rental Property.

  2. Assumption of Risk: The Tenant acknowledges and agrees that the use of the Rental Property involves certain inherent risks, including but not limited to property damage, personal injury, and death. The Tenant voluntarily assumes all such risks and agrees that the Released Parties shall not be liable for any such risks.

  3. Insurance: The Tenant agrees to maintain appropriate insurance coverage (such as renter's insurance) to protect against any loss or damage to personal property and to provide liability coverage for any claims arising out of the Tenant's use or occupancy of the Rental Property.

  4. No Waiver of Rights: Nothing in this Agreement shall be construed as a waiver of the Landlord's rights or remedies under applicable law, including but not limited to the right to seek damages for any breach of this Agreement.

  5. Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

  6. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflicts of law principles.
