STRATA BYLAWS

Article 1: Definitions

1.2. Owner: An individual or entity holding legal title to a strata-titled property within the strata property.

1.3. Tenant: An individual or entity occupying a strata-titled property within the strata property under a lease or rental agreement.

1.4. Council: The strata council elected or appointed to manage the affairs of the strata property as per the Strata Property Act.

1.5. Common Property: Areas, facilities, and amenities within the strata property not designated as part of individual strata-titled properties.

1.6. Strata Fees: Monetary contributions levied by the strata council to cover the costs associated with the administration, operation, and maintenance of the strata property.

Article 2: Strata Governance

2.1. Formation of Strata Council: A strata council shall be formed, comprising owners elected or appointed under the Strata Property Act.

2.2. Powers and Duties: The strata council shall have the authority to enforce these bylaws, manage common property, collect strata fees, and make decisions concerning the administration and maintenance of the strata property.

2.3. Meetings: The strata council shall hold regular meetings to discuss matters about the strata property. Notice of meetings shall be provided to all owners in advance.

Article 3: Use of Strata Property

3.1. Occupancy: Owners and tenants shall occupy their strata-titled properties in a manner that does not disturb the quiet enjoyment of others within the strata property.

3.2. Alterations: Owners shall seek prior approval from the strata council before making alterations to their strata-titled properties that may affect the structural integrity or appearance of the building or complex.

3.3. Common Areas: Owners and tenants shall use common property under its designated purpose and shall not obstruct or damage common areas, facilities, or amenities.

Article 4: Maintenance and Repairs

4.1. Responsibility: Owners shall be responsible for the maintenance and repairs of their respective strata-titled properties, including fixtures and improvements contained therein.

4.2. Common Property: The strata council shall oversee the maintenance and repairs of common property, including structural elements, exterior surfaces, and shared utilities.

4.3. Insurance: Owners shall maintain adequate insurance coverage for their strata-titled properties, and the strata council shall maintain insurance for common property as required by law.

Article 5: Financial Matters

5.1. Strata Fees: Owners shall pay strata fees as determined by the strata council to cover the costs of operating, maintaining, and administering the strata property.

5.2. Budget: The strata council shall prepare an annual budget outlining anticipated expenses and strata fees for the upcoming fiscal year, which shall be distributed to all owners for review.

5.3. Financial Records: The strata council shall maintain accurate financial records and make them available for inspection by owners upon request.

Article 6: Enforcement and Dispute Resolution

6.1. Enforcement: The strata council may enforce these bylaws through warnings, fines, or legal action as deemed necessary to ensure compliance by owners and tenants.

6.2. Dispute Resolution: Disputes arising between owners, tenants, or the strata council shall be resolved under the dispute resolution mechanisms outlined in the Strata Property Act or through alternative dispute resolution methods agreed upon by the parties involved.

These bylaws are established to promote harmonious living within the strata property and to ensure the proper management and maintenance of the shared environment. Owners and tenants are expected to adhere to these bylaws for the benefit of all residents and the overall well-being of the community.
