Chilliwack Bylaws


Following the authority vested in the municipal government of Chilliwack, British Columbia, Canada, and with due consideration for the well-being, safety, and prosperity of its residents, the following bylaws are hereby established. These bylaws serve to regulate various aspects of community life, promote public health and safety, and ensure the harmonious coexistence of all residents within the municipality.

Section 1: General Provisions

1.1 Title and Citation

These bylaws shall be known as the "Chilliwack Municipal Bylaws" and may be cited as such. They shall apply within the jurisdictional boundaries of the City of Chilliwack.

1.2 Authority

These bylaws are enacted according to the statutory authority granted to the municipal government of Chilliwack under the British Columbia Community Charter and other relevant legislation.

1.3 Interpretation

In the interpretation of these bylaws, words importing the singular include the plural and vice versa, and words importing a gender include all genders. Wherever possible, these bylaws shall be interpreted in a manner consistent with the objectives stated in the preamble.

1.4 Severability

If any provision of these bylaws is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the bylaws, which shall continue to be in full force and effect.

Section 2: Public Health and Safety

2.1 Noise Control

It shall be unlawful for any person to create or cause to be created any noise that disturbs the peace of the neighborhood between the hours of 10:00 PM and 7:00 AM.

2.2 Animal Control

All domestic animals within the municipality shall be kept under control by their owners and shall not be allowed to roam freely. Dog owners must ensure that their pets are licensed and vaccinated by municipal regulations.

2.3 Waste Management

Property owners are responsible for the proper disposal of waste generated on their premises. Waste must be placed in designated containers and disposed of by municipal waste management guidelines.

2.4 Fire Safety

All buildings within the municipality must comply with fire safety regulations established by the British Columbia Building Code. Property owners shall maintain clear access to fire hydrants and ensure that smoke detectors are installed and operational.

Section 3: Land Use and Development

3.1 Zoning Regulations

Land use within the municipality shall be governed by zoning regulations established by the City of Chilliwack. Property owners must obtain the necessary permits and approvals before undertaking any development or construction activities.

3.2 Building Standards

All buildings and structures within the municipality must adhere to the standards outlined in the British Columbia Building Code. Property owners shall ensure that buildings are maintained in a safe and structurally sound condition.

3.3 Environmental Protection

Development activities must be conducted in a manner that minimizes adverse impacts on the natural environment. Property owners shall comply with regulations about tree preservation, erosion control, and habitat conservation.

Section 4: Traffic and Transportation

4.1 Traffic Regulations

All vehicles operating within the municipality shall comply with the British Columbia Motor Vehicle Act and other applicable traffic laws. Speed limits, parking restrictions, and traffic control devices shall be enforced to ensure the safe and orderly flow of traffic.

4.2 Parking Enforcement

Parking on public streets and in municipal lots shall be regulated by parking bylaws established by the City of Chilliwack. Violators may be subject to fines or towing at their own expense.

4.3 Pedestrian Safety

Drivers must exercise caution and yield to pedestrians at crosswalks and intersections. Pedestrians shall obey traffic signals and use designated crosswalks whenever possible.

Section 5: Enforcement and Penalties

5.1 Enforcement Officers

Enforcement of these bylaws shall be carried out by designated municipal officers authorized to issue warnings, citations, and fines for violations.

5.2 Penalties

Violations of these bylaws may result in fines, penalties, or other enforcement actions as prescribed by municipal regulations. Repeat offenders may be subject to escalating penalties or legal action.

5.3 Dispute Resolution

Persons who wish to contest a bylaw violation notice may request a hearing before an independent adjudicator appointed by the municipality. Decisions rendered by the adjudicator shall be final and binding.

Section 6: Repeal and Amendment

6.1 Repeal

All bylaws and parts of bylaws inconsistent with the provisions of these bylaws are hereby repealed.

6.2 Amendment

These bylaws may be amended from time to time by resolution of the municipal council following public consultation and due process.

Section 7: Effective Date

7.1 Effective Date

These bylaws shall come into force and take effect on the date of their adoption by the municipal council.
