STRATA PARKING BYLAWS


Article I: Definitions

Section 1.1: "Strata Development" refers to the entire property subject to strata ownership, including all buildings, common areas, and parking facilities.

Section 1.2: "Strata Lot Owner" refers to an individual or entity that owns a strata lot within the strata development.

Section 1.3: "Tenant" refers to an individual or entity that rents or leases a strata lot within the strata development.


Article II: Parking Allocation

Section 2.1: Each strata lot owner shall be allocated a certain number of parking spaces as specified in the strata plan.

Section 2.2: Parking spaces shall be designated as either assigned or visitor parking, with clear signage indicating the allocation.


Article III: Use of Parking Spaces

Section 3.1: Strata lot owners and tenants shall use their allocated parking spaces for parking vehicles only.

Section 3.2: Parking in designated visitor parking spaces is limited to visitors of strata lot owners and tenants.

Section 3.3: Parking in common areas, driveways, and fire lanes is strictly prohibited.


Article IV: Parking Fees and Charges

Section 4.1: The strata council may impose parking fees and charges for the use of parking spaces, which shall be determined in accordance with the strata corporation's budget and financial requirements.

Section 4.2: Parking fees and charges shall be paid by strata lot owners and tenants in a timely manner as determined by the strata council.


Article V: Parking Enforcement

Section 5.1: The strata council may appoint a parking enforcement officer to enforce these bylaws and ensure compliance with parking rules and regulations.

Section 5.2: Violations of these bylaws may result in the issuance of parking citations, fines, or other penalties as determined by the strata council.


Article VI: Parking Disputes

Section 6.1: Any disputes regarding parking allocation or use shall be resolved in accordance with the dispute resolution process outlined in the strata corporation's bylaws.

Section 6.2: Strata lot owners and tenants shall cooperate in good faith to resolve parking disputes in a timely and amicable manner.


Article VII: Amendments to Bylaws

Section 7.1: These bylaws may be amended by a resolution passed by a majority vote at a duly convened meeting of the strata corporation.

Section 7.2: Notice of any proposed amendments to these bylaws shall be given to strata lot owners and tenants in accordance with the strata corporation's bylaws.


Article VIII: Interpretation

Section 8.1: These bylaws shall be interpreted and enforced in accordance with the Strata Property Act and any other relevant legislation.

Section 8.2: In the event of any conflict or inconsistency between these bylaws and the strata corporation's bylaws or the Strata Property Act, the latter shall prevail.


Article IX: Effective Date

Section 9.1: These bylaws shall come into effect on the date of registration with the Land Title Office.

Section 9.2: All strata lot owners and tenants shall be bound by these bylaws upon their effective date.


Article X: Conclusion

Section 10.1: These Strata Parking Bylaws are intended to promote the orderly and efficient use of parking facilities within the strata development and to ensure that all strata lot owners, tenants, and visitors adhere to the rules and regulations set forth herein.

Section 10.2: It is the responsibility of each strata lot owner and tenant to familiarize themselves with these bylaws and to comply with them at all times.
