Article I: Introduction

1.1 Name: The name of this association shall be the Pine Grove Condominium Association, hereinafter referred to as the "Association".

1.2 Purpose: The purpose of these bylaws is to establish rules and regulations for the use, maintenance, and alteration of common areas, limited common areas, and individual units within the condominium property in accordance with the Illinois Condominium Property Act and other applicable laws.

Article II: Definitions

2.1 Common Areas: Common areas shall refer to all portions of the condominium property that are not part of any individual unit, including but not limited to hallways, elevators, parking lots, and recreational facilities.

2.2 Limited Common Areas: Limited common areas shall refer to those portions of the condominium property designated for the exclusive use of one or more but not all of the unit owners.

2.3 Individual Units: Individual units shall refer to the portions of the condominium property owned and occupied by the unit owners, including any appurtenant balconies, patios, or storage spaces.

Article III: Use of Common Areas

3.1 General Use: All unit owners and their guests shall have the non-exclusive right to use and enjoy the common areas in accordance with these bylaws and any rules and regulations established by the Association.

3.2 Restrictions: The Board of Directors may impose reasonable restrictions on the use of common areas to ensure the safety, security, and enjoyment of all unit owners and their guests.

3.3 Prohibited Activities: Prohibited activities within the common areas shall include but are not limited to excessive noise, littering, vandalism, and behavior that disrupts the peaceful enjoyment of other unit owners.

Article IV: Maintenance of Common Areas

4.1 Responsibility: The Association shall be responsible for the maintenance, repair, and replacement of all common areas, including landscaping, utilities, and structural components.

4.2 Assessments: The cost of maintaining the common areas shall be funded by assessments levied against all unit owners in accordance with the Association's budget and financial obligations.

4.3 Maintenance Standards: The Board of Directors shall establish maintenance standards for the common areas to ensure they remain in a safe and attractive condition for the benefit of all unit owners.

Article V: Alteration of Common Areas

5.1 Approval Process: Any proposed alterations or improvements to the common areas must be approved by the Board of Directors and, if required by law, by a majority vote of the unit owners.

5.2 Architectural Guidelines: The Board of Directors may establish architectural guidelines governing the design, materials, and construction methods for alterations to the common areas to maintain aesthetic consistency and structural integrity.

5.3 Cost Allocation: The cost of any alterations or improvements to the common areas shall be borne by the Association and may be funded through special assessments or reserve funds as determined by the Board of Directors.

Article VI: Use of Limited Common Areas

6.1 Exclusive Use: Unit owners with rights to limited common areas shall have the exclusive right to use and enjoy those areas in accordance with the provisions of their deed or other governing documents.

6.2 Maintenance: Unit owners with rights to limited common areas shall be responsible for the maintenance, repair, and replacement of those areas to the extent required by the Association's rules and regulations.

6.3 Restrictions: The Board of Directors may impose reasonable restrictions on the use of limited common areas to prevent damage or interference with the rights of other unit owners.

Article VII: Enforcement

7.1 Compliance: All unit owners and their guests shall comply with these bylaws, as well as any rules and regulations established by the Association, failure to comply may result in penalties or legal action as permitted by law.

7.2 Enforcement Authority: The Board of Directors shall have the authority to enforce these bylaws and rules through fines, assessments, and other remedies as provided for in the Association's governing documents and applicable law.

7.3 Dispute Resolution: Disputes regarding the interpretation or enforcement of these bylaws shall be resolved through the Association's established dispute resolution procedures, which may include mediation or arbitration.

Article VIII: Amendments

8.1 Amendment Process: These bylaws may be amended by a vote of the unit owners in accordance with the procedures set forth in the Association's governing documents and applicable law.

8.2 Notice: Notice of any proposed amendments shall be provided to all unit owners in writing at least thirty (30) days prior to the vote, along with a summary of the proposed changes and the date, time, and location of the meeting at which the vote will take place.

8.3 Effective Date: Any amendments to these bylaws shall become effective upon approval by the requisite vote of the unit owners and compliance with any legal requirements for recording or filing.

Article IX: Miscellaneous Provisions

9.1 Severability: If any provision of these bylaws is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

9.2 Governing Law: These bylaws shall be governed by and construed in accordance with the laws of the State of Illinois.

9.3 Headings: The headings used in these bylaws are for convenience only and shall not be deemed to affect the meaning or interpretation of any provision herein.

Article X: Adoption

These bylaws shall be adopted by the initial board of directors upon the formation of the Association and shall thereafter be binding on all unit owners, tenants, and occupants of the condominium property.
