Alberta Condo Bylaws

Article I: Introduction

1.1 Title: These bylaws shall be known and may be cited as the [Condominium Corporation Name] Condominium Bylaws.

1.2 Definitions: In these bylaws, unless the context otherwise requires, the following terms shall have the meanings ascribed to them:

  • "Board of Directors" refers to the duly elected governing body of the condominium corporation.

  • "Owner" means the registered owner of a condominium unit.

  • "Resident" refers to any person residing within a condominium unit, whether as an owner, tenant, or guest.

  • "Common Elements" include all parts of the condominium property other than the units.

Article II: Rights and Responsibilities of Owners and Residents

2.1 Ownership Rights: Owners shall have the exclusive right to occupy and use their respective units, subject to the provisions of these bylaws and the declaration.

2.2 Maintenance Responsibilities: Owners shall be responsible for the maintenance and repair of their units, including any alterations or improvements made thereto.

2.3 Use of Common Elements: Residents shall be entitled to use the common elements by the declaration and these bylaws, provided such use does not interfere with the rights of other residents.

2.4 Payment of Common Expenses: Owners shall be responsible for paying their proportionate share of common expenses, as determined by the board of directors.

2.5 Conduct of Residents: Residents shall conduct themselves in a manner that does not interfere with the quiet enjoyment of other residents or the peaceful operation of the condominium property.

Article III: Governance

3.1 Board of Directors: The affairs of the condominium corporation shall be managed by a board of directors elected by the owners under the declaration and these bylaws.

3.2 Powers and Duties: The board of directors shall have the power to make and enforce rules and regulations governing the use and enjoyment of the condominium property, subject to the provisions of the declaration and these bylaws.

3.3 Meetings: The Board of Directors shall hold regular meetings at such times and places as it may determine, and special meetings may be called by the president or any two directors upon notice to all members of the board.

3.4 Quorum: A majority of the directors shall constitute a quorum for the transaction of business at any meeting of the board.

Article IV: Amendments

4.1 Amendment Procedure: These bylaws may be amended by a resolution of the owners passed by a majority vote at a meeting duly called for that purpose, provided that notice of the proposed amendment has been given to all owners at least [insert time frame] days before the meeting.

4.2 Registration: Any amendment to these bylaws shall be registered against the title of the condominium property following the requirements of the Alberta Condominium Property Act.

Article V: Miscellaneous Provisions

5.1 Severability: If any provision of these bylaws is determined to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision herein.

5.2 Governing Law: These bylaws shall be governed by and construed under the laws of the Province of Alberta.

Article VI: Effective Date

6.1 Adoption: These bylaws shall come into force upon adoption by a majority vote of the owners at a meeting duly called for that purpose.
