PROPERTY MANAGEMENT AGREEMENT


This Property Management Agreement (hereinafter referred to as the "Agreement") is entered into this [Date] by and between [Your Name] (hereinafter referred to as the "Property Owner") and [property management company] (hereinafter referred to as the "Property Manager").

1. APPOINTMENT AND ACCEPTANCE

The Property Owner hereby engages the Property Manager to exclusively manage, operate, control, rent, and lease the property located at [Property Address] (hereinafter referred to as the "Property"), including but not limited to all improvements, fixtures, and appurtenances thereto, as specified in this Agreement. The Property Manager accepts the appointment and agrees to conduct such duties professionally and in the best interest of the Property Owner.

2. PROPERTY MANAGEMENT SERVICES

The Property Manager agrees to provide the following property management services:

  • Advertising the Property: The Property Manager shall advertise the Property using appropriate channels to attract potential tenants.

  • Tenant Screening and Selection: The Property Manager shall conduct thorough tenant screening, including background checks, credit checks, and rental history verification, to select suitable tenants for the Property.

  • Rent Collection: The Property Manager shall collect rent from tenants on behalf of the Property Owner and maintain accurate records of rental payments.

  • Financial Record Keeping: The Property Manager shall maintain detailed financial records related to the Property, including income and expenses, and provide regular financial reports to the Property Owner.

  • Maintenance and Repairs: The Property Manager shall address maintenance and repair requests promptly and ensure that the Property is maintained in good condition.

  • Compliance: The Property Manager shall comply with all applicable local, state, and federal laws and regulations regarding the management and operation of the Property.

3. TERM OF AGREEMENT

This Agreement is slated to officially commence on the specified April 15, 2050, and it is set to remain in effect, continuing perpetually until the designated [End April 15, 2055. However, there exists an additional clause that allows for an earlier termination of the Agreement by either of the two parties involved. They just need to provide notice in writing, expressing their wish to discontinue the Agreement, and they are obligated to do so at least thirty (30) days before the desired termination date.

4. COMPENSATION

In consideration for the property management services provided by the Property Manager, the Property Owner agrees to pay the Property Manager a fee equivalent to [Percentage] of the total monthly rent revenue collected. Additionally, the Property Owner shall reimburse the Property Manager for any approved expenses incurred in the management of the Property, provided they are within an agreed budget and with the prior approval of the Property Owner.

5. INDEMNIFICATION

The Property Owner agrees to indemnify and hold the Property Manager harmless against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to the Property, except in cases of gross negligence or willful misconduct by the Property Manager.

6. GOVERNING LAW

This Agreement shall be governed by and construed under the laws of [State/Country], without regard to its conflict of laws principles.
