Individual Flexibility Agreement

This Individual Flexibility Agreement ("Agreement") is made between [Your Company Name], a company registered under the laws of [Country/State], having its registered office at [Your Address] ("Employer"), and [Employee's Name], residing at [Employee's Address] ("Employee"). This Agreement is entered into to facilitate variations to certain terms and conditions of employment.

1. PURPOSE OF THE AGREEMENT

The purpose of this Agreement is to allow the Parties to negotiate deviations from the standard terms and conditions set out in the existing employment agreement to provide greater flexibility and to better align with their individual needs.

2. SCOPE OF THE AGREEMENT

The foregoing agreement between the Parties only applies to the specific terms and conditions outlined within the body of this Agreement. Henceforth, all other conditions and considerations regarding the employment relationship shall remain unchanged and will continue to be governed by the existing employment contract, save for the specific provisions contained within this Agreement.

3. AMENDMENTS TO TERMS OF EMPLOYMENT

From the date of effect of this Agreement, the following changes will be implemented:

  • Working Hours:

    Current: 40 hours per week

    Proposed Variation: 35 hours per week

  • Working Patterns:

    Current: Monday to Friday, 9:00 AM to 5:00 PM

    Proposed Variation: Flexible working hours, to be mutually agreed upon between the Employer and the Employee weekly.

  • Working Location:

    Current: On-site at [Employer's Address]

    Proposed Variation: Remote work for three days a week, with two days to be worked on-site.

  • Remuneration:

    • Current: [Amount] per annum

    • Proposed Variation: Increase to [Amount] per annum, effective from the 20th day of January 2050.

These Changes shall be agreed upon and duly ratified by the Parties involved based on the nature and conditions of work and shall replace the corresponding provisions of the existing employment agreement.

4. REVIEW OF THE AGREEMENT

The Parties agree to periodically review and evaluate the terms and provisions of this Agreement (but not exceeding approximately one (1) year from its inception) to ensure that they continue to meet the needs and expectations of both parties involved.

5. CONFIDENTIALITY AND NON-DISCLOSURE

Both parties agree to maintain confidentiality regarding any confidential information obtained during employment or through the execution of this Agreement. This obligation shall survive the termination of employment.

6. TERMS AND TERMINATION

Termination of this Agreement may occur under the following conditions:

  • By mutual agreement of both parties

  • Under the terms of the original employment agreement

  • Any other conditions as mutually agreed upon and documented in writing

7. DISPUTE RESOLUTION

In the event of any dispute arising out of or in connection with this Agreement, both parties agree to attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved informally, it shall be referred to [Arbitration] as per the laws governing this Agreement.
