Article 1: Title and Interpretation

1.1 Title: These bylaws shall be known as the "Prince Albert Business Licensing Bylaws."

1.2 Interpretation: In these bylaws, unless the context otherwise requires, words importing the singular number include the plural and vice versa, words importing gender include all genders and references to persons include individuals, corporations, partnerships, and other legal entities.

Article 2: Scope and Application

2.1 Scope: These bylaws shall apply to all businesses operating within the municipal boundaries of Prince Albert, Saskatchewan.

2.2 Application: Every person engaging in any trade, occupation, profession, or business within Prince Albert shall obtain a business license under the provisions of these bylaws.

Article 3: Licensing Requirements

3.1 General Requirements: All businesses must obtain a license from the municipal government before commencing operations. The application for a business license shall be made on forms provided by the municipality and shall include all required information and documentation.

3.2 Fees: The fees for business licenses shall be set by the City Council and may vary depending on the type and size of the business. The fees shall be payable upon application and annually thereafter.

3.3 Exemptions: Certain businesses or activities may be exempt from the licensing requirements as determined by the City Council. Such exemptions shall be granted on a case-by-case basis.

Article 4: Application Process

4.1 Submission of Application: All applications for business licenses shall be submitted to the municipal licensing department along with the required documentation and fees.

4.2 Review and Approval: The licensing department shall review each application to ensure compliance with all applicable regulations and requirements. Upon satisfactory review, the license shall be issued to the applicant.

4.3 Denial of Application: If an application is deemed incomplete or does not meet the requirements of these bylaws, the licensing department may deny the application. The applicant shall be notified of the reasons for the denial and may have the opportunity to remedy the deficiencies.

Article 5: Conditions of License

5.1 Display of License: Every licensee shall prominently display the business license at the place of business for which it is issued.

5.2 Compliance with Regulations: All licensees shall comply with all applicable federal, provincial, and municipal laws, regulations, and bylaws relating to their business operations.

5.3 Reporting Changes: Licensees shall notify the licensing department of any changes to their business information or operations within a specified period.

Article 6: Enforcement

6.1 Inspections: Authorized officers of the municipality may conduct inspections of licensed businesses to ensure compliance with these bylaws and other regulations.

6.2 Penalties: Any person found to violate these bylaws may be subject to fines, penalties, or other enforcement measures as prescribed by law.

6.3 Suspension or Revocation of License: The municipality may suspend or revoke a business license for non-compliance with these bylaws or other applicable regulations.

Article 7: Appeals

7.1 Right to Appeal: Any person aggrieved by a decision of the licensing department may appeal to the City Council within a specified period.

7.2 Hearing: The City Council shall hold a hearing to consider the appeal and may affirm, reverse, or modify the decision of the licensing department.

Article 8: Transitional Provisions

8.1 Existing Businesses: Businesses operating within the municipal boundaries of Prince Albert before the enactment of these bylaws shall have a specified period to comply with its provisions and obtain a license.

Article 9: Administration

9.1 Administration: The administration of these bylaws shall be the responsibility of the municipal licensing department, which shall have the authority to enforce its provisions.

Article 10: Repeal

10.1 Repeal: Any bylaws or parts of bylaws inconsistent with the provisions of these bylaws are hereby repealed.

Final Provisions

These bylaws shall come into force and effect upon enactment by the City Council and shall be subject to review and amendment as necessary.
