Marathon Event Release of Liability

I. Introduction

This Marathon Event Release of Liability ("Release") is entered into by and between [Your Name] ("Organizer") and the undersigned participant ("Participant") in the [Name of Marathon Event] ("Event"). By signing this Release, the Participant agrees to release, discharge, and hold harmless the Organizer from any liability arising out of participation in the Event.

II. Release of Claims

Participant, acting not only on their behalf but also on behalf of their heirs, executors, administrators, and assigns, hereby grants a full and unconditional release and forever discharges the Organizer, its affiliates, officers, directors, employees, agents, volunteers, sponsors, and all other individuals or entities associated with the Event (hereinafter collectively referred to as the "Released Parties"), from any claims, liabilities, demands, actions, or causes of action whatsoever.

Comprehensive Release: Participant acknowledges and agrees that this release is comprehensive and includes, but is not limited to, any claims for personal injury, property damage, or any other loss, damage, or injury, whether foreseeable or unforeseeable, and whether caused by negligence or otherwise, arising from or connected to their participation in the Event.
Scope of Released Parties: Participant understands that the Released Parties include not only the Organizer but also its affiliates, officers, directors, employees, agents, volunteers, sponsors, and any other individuals or entities involved in organizing, promoting, or facilitating the Event, regardless of their specific role or level of involvement.
Waiver of Future Claims: Participant expressly waives any right to assert or maintain any claim or cause of action against the Released Parties arising out of or related to the Event, whether such claim or cause of action arises before, during, or after the Event, and regardless of whether Participant is aware of the existence of such claim or cause of action at the time of signing this Release.
Final and Binding: Participant acknowledges that this release is final and binding and that they are releasing the Released Parties from all known and unknown claims, liabilities, and obligations, whether or not expressly mentioned in this Release.
Assumption of Responsibility: Participant accepts full responsibility for any consequences, injuries, losses, or damages that may result from their participation in the Event, and agrees not to hold the Released Parties liable for any such consequences, injuries, losses, or damages.

III. Consideration

Participant acknowledges that they are engaging in participation in the Event of their own free will and without any form of coercion. By signing this Release, the Participant agrees that the very opportunity to partake in the Event represents significant and valuable consideration exchanged between the Participant and the Organizer.

Access to the Event: Participant acknowledges that the Organizer is granting them access to the Event, which may involve various amenities, facilities, and experiences.
Experience and Enjoyment: The participant recognizes the opportunity to experience and enjoy the Event, including the physical activity, camaraderie, and any associated entertainment or festivities.
Personal Growth and Achievement: The participant understands that participation in the Event may contribute to personal growth, fitness goals, and a sense of achievement through completing the Marathon.
Community Engagement: The participant acknowledges the chance to engage with the local community, fellow participants, volunteers, and supporters, fostering connections and a sense of belonging.
Health and Wellness: The participant values the potential health and wellness benefits associated with participating in the Marathon, including physical exercise and the promotion of an active lifestyle.
Charitable Contribution: If applicable, Participants may recognize that their participation in the Event supports charitable causes or organizations, contributing to the betterment of society.

IV. Acknowledgment of Understanding

Participant acknowledges that they have carefully read and fully understand the terms of this Release. Participant agrees that they are giving up substantial legal rights by signing this Release and that they are signing it voluntarily and of their own free will.

Informed Consent: Participant acknowledges that they have been provided with sufficient time and opportunity to review this Release, ask questions, seek clarification, and consider its implications before signing.
Understanding of Rights: Participant is fully aware that by signing this Release, they are relinquishing and waiving significant legal rights, including but not limited to the right to pursue legal action against the Released Parties for any claims arising from or related to their participation in the Event.
Voluntary Agreement: Participant confirms that their decision to sign this Release is voluntary and made of their own free will, without any duress, coercion, or undue influence from any party.
Assumption of Risk Acknowledgment: Participant understands and acknowledges the inherent risks associated with participating in the Event, including but not limited to risks of injury, illness, or property damage. Participant assumes these risks voluntarily and willingly.
Legal Ramifications: Participant acknowledges that this Release constitutes a legally binding agreement between themselves and the Released Parties. By signing, Participant agrees to be bound by the terms of this Release.
Certification of Understanding: Participant affirms that they have had the opportunity to seek legal counsel or advice regarding the contents of this Release and that they are signing it with a clear understanding of its legal consequences.

V. Assumption of Risk

Participant acknowledges that participation in the Event involves inherent risks, including but not limited to the risk of injury, illness, or death, and the risk of damage to or loss of personal property. Participant assumes all such risks and agrees to accept full responsibility for any injuries, damages, or losses that may occur as a result of participation in the Event.

Risk of Injury: The participant acknowledges that participating in the Event carries a risk of bodily injury, including sprains, strains, fractures, cuts, bruises, and other injuries, whether minor or severe.
Risk of Illness: Participant understands that participation in the Event may expose them to the risk of contracting illnesses or diseases, including but not limited to viral infections or communicable diseases.
Risk of Death: Participant acknowledges that there is a risk of fatal injuries or death associated with participating in the Event, whether due to accidents, medical conditions, or other unforeseen circumstances.
Risk of Property Damage or Loss: Participant acknowledges that personal property brought to or used during the Event may be damaged, lost, or stolen, and assumes responsibility for safeguarding their belongings.

VI. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to Participant's participation in the Event or any breach of this Release by Participant.

Claims and Liabilities: Participant agrees to indemnify the Released Parties against any claims or liabilities asserted against them by third parties, including but not limited to claims for personal injury, property damage, or any other harm allegedly caused by Participant's actions or omissions during the Event.
Damages and Losses: Participant agrees to indemnify the Released Parties for any damages or losses incurred as a result of Participant's participation in the Event, including but not limited to damages to property, costs of medical treatment, or any other expenses incurred by the Released Parties as a result of Participant's actions.
Costs and Expenses: Participant agrees to reimburse the Released Parties for any costs, expenses, or fees incurred in defending against any claims or liabilities arising out of the Participant's participation in the Event, including but not limited to attorneys' fees, court costs, and any other legal expenses
Breach of Release: Participant agrees to indemnify the Released Parties for any damages or losses suffered as a result of Participant's breach of any provision of this Release, including but not limited to failure to comply with safety rules or regulations, misrepresentation of facts, or any other violation of Participant's obligations under this Release.

VII. Severability

If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Preservation of Intent: The participant understands that this provision intends to ensure that if any part of the Release is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
Interpretation and Modification: Participant agrees that if any provision of this Release is held to be invalid, illegal, or unenforceable, it shall be interpreted, modified, or reformed to the extent necessary to render it valid, legal, and enforceable while preserving the intent of the original provision to the maximum extent possible.
Enforceability of Remainder: Participant acknowledges that even if one or more provisions of this Release are deemed invalid or unenforceable, the remainder of the Release shall continue to be binding and enforceable against all parties involved.
Separate and Independent: The participant understands that each provision of this Release is separate and independent of the others, and the invalidity or unenforceability of any one provision shall not affect the validity or enforceability of the other provisions.
