Membership Release Of Liability
This Release of Liability ("Agreement") is entered into as of this [DATE] by and between [YOUR NAME] or [YOUR COMPANY NAME], with its principal place of business at [YOUR COMPANY ADDRESS], (hereinafter "the Provider"), and the undersigned (hereinafter "the Participant").
I. ASSUMPTION OF RISK
The Participant understands that the activities and services provided by the Provider may involve risks, which include, but are not limited to, property damage, bodily injury, and possible death. The Participant voluntarily assumes full responsibility for all risks involved.
II. RELEASE AND WAIVER OF LIABILITY
The Participant, on behalf of himself/herself, his/her personal representatives, heirs, and next of kin, releases and waives all claims against the Provider, its officers, agents, and employees for any injuries, damages, losses, or claims, whether known and unknown, which arise out of or are connected in any way to the Participant’s membership or participation, whether or not caused by the negligence or other fault of the Provider.
III. INDEMNIFICATION
The Participant also agrees to indemnify and hold harmless the Provider from any claims, actions, suits, procedures, costs, expenses, damages, and liabilities including attorney’s fees, brought as a result of the Participant’s membership and to reimburse them for any such expenses incurred.
IV. SEVERABILITY
If any provision, or portion thereof, of this Agreement, is declared invalid for any reason by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions or portions of this Agreement. The remaining provisions or portions shall continue to be valid and enforceable to the fullest extent permitted by law.
If any provision of this Agreement is determined to be invalid or unenforceable, the parties agree to negotiate in good faith to replace such provision with a valid and enforceable provision that reflects as closely as possible the original intent of the parties.
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
V. ACKNOWLEDGMENT
By signing this Membership Release of Liability, the Participant affirms that he/she is at least 18 years of age, has fully understood, and consents to all terms and conditions listed above.
