2. They have had the opportunity to seek legal advice before executing this Release and have either done so or waived their right to seek legal advice knowingly.

3. They fully understand the legal effect of this Release and the final and binding effect this Release may have on their legal rights against the Releasee.

The Releasor affirms that they are of legal age and have the legal capacity to enter into this Agreement.

II. RELEASE OF LIABILITY

The Releasor, in acknowledging the provided considerations, releases the Releasee from any present or future claims or damages, personal injury, or death due to participation in the Activity, irrespective of location or negligence by the Releasee, and will not sue the Releasee for the same.

III. INDEMNIFICATION

The Releasor agrees to indemnify and hold the Releasee harmless from all obligations, damages, penalties, claims, costs, charges, and expenses, including attorney’s fees, which may be imposed upon, incurred by, or asserted against the Releasee because of any act, omission, or negligence of the Releasor.

IV. GOVERNING LAW

This Agreement shall be governed by and construed under the laws of the State of [State], without regard to its conflict of laws principles. Any disputes arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of [State].

V. SEVERABILITY
