Equipment Waiver

I. Introduction

II. Purpose

Participation in these Activities carries inherent risks, including the risk of serious injury or death. This Agreement is designed to inform the Participant of these risks and to release the Provider from liability.

III. Assumption of Risk

The Participant acknowledges and understands that participation in the Activities involves inherent risks, including but not limited to:

Risk of injury or death due to falls, collisions, or other accidents.
Risk of injury or death due to equipment failure or malfunction.
Risk of injury or death due to natural hazards, weather conditions, or other environmental factors.

The Participant voluntarily assumes all risks associated with participation in the Activities.

IV. Release of Liability

In consideration of being allowed to participate in the Activities, the Participant hereby releases, waives, discharges, and covenants not to sue the Provider, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant while participating in the Activities.

V. Indemnification

The Participant agrees to indemnify, defend, and hold harmless the Provider from and against any and all liability, claims, demands, actions, and causes of action arising out of or related to the Participant's participation in the Activities.

VI. Acknowledgment of Understanding

The Participant acknowledges that they have carefully read and fully understand the terms of this Agreement. They acknowledge that they are freely and voluntarily entering into this Agreement.

VII. Governing Law
