Travel Waiver

I. Introduction

This Travel Waiver Agreement (the "Agreement") is entered into between [YOUR TRAVEL AGENCY NAME], located at [AGENCY ADDRESS] (hereinafter referred to as the "Agency"), and [TRAVELER NAME] (hereinafter referred to as the "Traveler"), regarding the travel services provided by the Agency as outlined herein.

II. Scope of Agreement

III. Assumption of Risks

The Traveler acknowledges and understands that travel inherently involves certain risks, including but not limited to:

Transportation accidents
Illness or injury
Property loss or damage
Natural disasters or emergencies

The Traveler agrees that [YOUR TRAVEL AGENCY NAME] shall not be held liable for any loss, damage, or injury incurred during travel, except in cases of gross negligence or willful misconduct on the part of the Agency.

IV. Health and Safety

[TRAVELER NAME] declares that they are medically able and properly equipped to engage in all activities associated with the travel itinerary. It is recommended that participants consult a healthcare provider, adhere to prescribed medications, and acquire necessary vaccinations prior to departure.

V. Release of Liability

In consideration of being permitted to travel, the Traveler hereby releases, waives, and discharges [YOUR TRAVEL AGENCY NAME] from any and all liability, claims, demands, actions, or rights of action arising out of or related to the travel services provided, including but not limited to any injury, damage, or loss.

VI. Indemnification

The Traveler agrees to indemnify and hold harmless [YOUR TRAVEL AGENCY NAME] from any loss, liability, damage, or cost, including attorney fees, arising out of or related to the Traveler's participation in the travel services or the violation of any law or the rights of a third party

VII. Cancellation and Refunds

[TRAVELER NAME] understands that any deposits or amounts paid in advance are non-refundable if the participant decides to cancel their travel plans. Exceptions to this policy are only applicable where detailed in the specific travel agreement signed prior to payment.

VIII. Consent to Medical Treatment

[TRAVELER NAME] consents to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during the travel activity. This release extends to [YOUR TRAVEL AGENCY NAME] as well as any personnel or hospital servicing in case of an emergency.

IX. Personal Data and Media

[TRAVELER NAME] agrees to allow [YOUR TRAVEL AGENCY NAME] to use photographs, video recordings, or any other visuals taken during the travel activities without compensation, for legitimate business purposes including but not limited to promotional presentations and marketing materials.

X. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which [YOUR TRAVEL AGENCY NAME] is located.

XI. Signature
