Free Sample Photography Liability Waiver

This Photography Liability Waiver and Release Agreement ("Agreement") is made and entered into this 16th day of April 2058, by and between [YOUR COMPANY NAME] ("Photographer"), and Jewell Ward ("Model" or "Client").

I. General Acknowledgment

By signing this Agreement, the Model/Client acknowledges and agrees that they are voluntarily participating in a photography session arranged and provided by [YOUR COMPANY NAME] and its representatives. The Model/Client understands that participation involves inherent risks, including but not limited to physical, emotional, or financial damages that may arise from participating in the session.

II. Release of Liability

In consideration of being allowed to participate in the photography session, the Model/Client agrees to release, discharge, and hold harmless [YOUR NAME], [YOUR COMPANY NAME], and their officers, employees, agents, contractors, successors, and assigns from any liability, claims, demands, causes of action, damages, or costs, including attorney’s fees, arising from or related to participation in the photography session. This release includes but is not limited to any injuries, losses, or damages to the Model/Client, their property, or any third parties.

III. Assumption of Risk

The Model/Client acknowledges that there may be inherent risks associated with participation in the photography session, including but not limited to, physical injuries, emotional distress, or personal property damage. The Model/Client voluntarily assumes all such risks, whether foreseeable or unforeseeable and agrees to proceed with the session at their own risk.

IV. Model/Client’s Responsibility

The Model/Client agrees that they are solely responsible for their actions during the photography session and for the safety of their personal belongings. The Model/Client agrees to comply with all reasonable instructions and directions provided by [YOUR COMPANY NAME] and its representatives.

V. Permission to Use Likeness

By signing this Agreement, the Model/Client grants [YOUR COMPANY NAME] the irrevocable right and permission to use their likeness, image, or appearance as part of any photographs, videos, or other media taken during the session, without limitation to time, location, or medium. This includes the use of such images for commercial, promotional, or advertising purposes, including but not limited to social media, website use, and print marketing.

The Model/Client acknowledges that they will receive no further compensation beyond the agreed-upon terms for the photography session, and they waive any right to royalties or other compensation arising from the use of their likeness in connection with the session.

VI. Indemnification

The Model/Client agrees to indemnify and hold harmless [YOUR NAME], [YOUR COMPANY NAME], and their representatives from any loss, liability, damage, or cost (including attorney’s fees) they may incur arising out of or related to the Model/Client’s participation in the photography session or use of the photographs.

VII. Governing Law

This Agreement shall be governed by and construed by the laws of the state in which [YOUR COMPANY NAME] is headquartered, without regard to its conflict of law principles.

VIII. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

IX. Entire Agreement

This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior negotiations, discussions, agreements, or understandings, whether written or oral. Any amendments to this Agreement must be made in writing and signed by both parties.
