I. Introduction
This Baseball Game Release of Liability (the "Release") is a legal document between [Your Name] (referred to as "the Organizer") and the undersigned participant, regarding participation in the baseball game organized by the Organizer. By signing this Release, the participant acknowledges and agrees to the terms and conditions outlined herein.
II. Acknowledgment of Risk
The individual participating in the baseball game acknowledges and is fully aware that choosing to partake in this activity includes several inherent risks. These risks include a myriad of possible dangers or problems, these are not confined to but certainly include the potential for bodily harm or physical injury, psychological or emotional injury, damage to personal property, or in the most extreme cases, even death. III. Assumption of Risk
The individual who participates in the baseball game does so voluntarily, thereby assuming complete responsibility for risks or dangers that are inherently associated with their participation in the game.
This includes but is not limited to, potential risks that may arise due to the current condition of the playing field, the behaviors and actions of other individuals also participating in the baseball game, potential equipment malfunctions or failures, or any unforeseen circumstances or incidences that might occur during the game.
IV. Waiver of Liability
In consideration of being allowed to participate in the baseball game, the participant hereby releases, waives, and discharges the Organizer, its officers, directors, employees, agents, volunteers, sponsors, or affiliates, from any claims, demands, liabilities, damages, or causes of action arising out of or related to participation in the baseball game.
V. Indemnity
The participant agrees to indemnify and hold harmless the Released Parties from and against any liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) incurred as a result of any claims or suits brought against them arising out of or related to the participant's participation in the baseball game.
VI. Governing Law
The rules and principles that will govern and interpret this Release will be those of the state of [State]. This will be the case irrespective of the principles of conflict of laws.
