1. Introduction
This Hunting Release of Liability Agreement ("Agreement") is entered into between [Your Company Name], hereinafter referred to as the "Club," and [Participant's Name], hereinafter referred to as the "Participant," concerning the Participant's participation in guided hunting trips or services provided by the Club.
2. Acknowledgment of Risks
The individual participating in the activity fully recognizes and understands that activities related to hunting inherently come with an assortment of risks. These may encompass various aspects such as enduring physical injuries or harm, sustaining property damage, and in severe cases, facing potential death, but are not strictly confined to these.
The risks and dangers associated with hunting may stem from a myriad of factors. This could relate to the unpredictable nature of wild animals that one might encounter during these types of activities or the conditions of the terrain in which the activities are taking place.
The possibility of dealing with equipment that unexpectedly fails or malfunctions is another risk that must be acknowledged. Moreover, the actions of others involved in hunting can also increase its risk and danger.
3. Assumption of Risk
The Participant voluntarily assumes all risks associated with participation in guided hunting trips or services provided by the Club. The Participant acknowledges that these risks cannot be eliminated and agrees to accept them as a condition of participation.
4. Release and Waiver of Claims
In consideration of being permitted to participate in guided hunting trips or services provided by the Club, the Participant, on behalf of themselves and their heirs, executors, administrators, successors, and assigns, hereby releases, waives, and forever discharges the Club, its officers, directors, employees, agents, representatives, volunteers, and affiliates from any liabilities, claims, actions, damages, costs, or expenses of any kind that may arise out of or in connection with the Participant's participation in hunting activities, including but not limited to, personal injury, property damage, or wrongful death.
5. Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Club, its officers, directors, employees, agents, representatives, volunteers, and affiliates from and against any liabilities, claims, actions, damages, costs, or expenses, including reasonable attorney's fees, arising out of or in connection with the Participant's participation in guided hunting trips or services provided by the Club.
6. Medical Treatment Authorization
The Participant authorizes the Club and its representatives to administer or arrange for any medical treatment that may be necessary in the event of any injury or illness suffered by the Participant during participation in guided hunting trips or services provided by the Club.
7. Severability
If a specific provision of this Agreement becomes invalid or unenforceable for whatever reason, it should be clarified that this will not impact the other provisions of the Agreement. The remaining provisions will remain legally sound, applicable, and enforceable, retaining their total force and efficacy.
8. Governing Law
This Agreement shall be governed by and construed under the laws of [State/Country].
9. Entire Agreement
