Facility Release Of Liability

I. Introduction

This Facility Release Of Liability ("Release") is entered into by and between [YOUR COMPANY NAME], located at [YOUR COMPANY ADDRESS], herein referred to as the "Facility," and the undersigned participant, herein referred to as the "Participant," in consideration of the Participant's use of the Facility's services and participation in activities offered by the Facility.

II. Assumption of Risk

The Participant understands and acknowledges that the use of the Facility's services and participation in activities involve inherent risks, including but not limited to, the risk of bodily injury, property damage, or death. The Participant voluntarily assumes all risks associated with such use and participation.

III. Release and Waiver

The Participant hereby releases, waives, and discharges the Facility, its owners, officers, directors, employees, agents, representatives, volunteers, and insurers (collectively, the "Released Parties") from any claims, liabilities, actions, damages, costs, or expenses, including but not limited to, medical expenses, attorney's fees, and loss of income, arising out of or in any way related to the Participant's use of the Facility's services or participation in activities, whether caused by the negligence of the Released Parties or otherwise.

IV. Indemnification

The individual who is participating (hereafter referred to as the Participant) is in full agreement with the understanding that they are to indemnify, uphold a defense for, and absolve the Parties that have been released from any responsibility. This extends to and encompasses any claims which may be made against them. Further, this transfers liability to the Participant for damages sustained, losses incurred, and costs or expenses that might be accrued. This may potentially include but is not necessarily limited to, fees that may be associated with hiring an attorney or any equivalent legal council. The conditions mentioned above may arise out of any situation or be in any way related to the Participant's decision to use the services provided by the Facility. It also applies to their decision to participate in the activities offered by the Facility.

V. Medical Authorization

The Participant authorizes the Facility and its representatives to administer or seek medical treatment for the Participant in the event of an emergency if the Participant is unable to consent to such treatment. The Participant agrees to bear all costs associated with any medical treatment received.

VI. Compliance with Rules and Regulations

The Participant agrees to comply with all rules, regulations, policies, and procedures established by the Facility, including but not limited to, safety guidelines, facility usage rules, and instructions provided by staff members.

VII. Governing Law

This Release shall be governed by and construed following the laws of [State], without regard to its conflict of law principles.

VIII. Severability

If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

IX. Entire Agreement

This Release constitutes the entire agreement between the Participant and the Facility concerning the subject matter herein and supersedes all prior or contemporaneous agreements and understandings, whether written or oral.
