Waiver Contract Format
This Waiver of Liability Agreement ("Agreement") is entered into as of [Date] by and between:
WHEREAS the Participant desires to participate in [Event/Activity/Program] (the "Activity") organized by the Provider.
NOW, THEREFORE, in consideration of the foregoing and the mutual promises set forth below, the parties agree as follows:
1. Acknowledgment of Risk
1.1 The Participant acknowledges and agrees that participation in the Activity may involve inherent risks, including but not limited to physical injury, property damage, or other harm.
1.2 The Participant voluntarily chooses to participate in the Activity, fully understanding the risks involved.
2. Waiver and Release
2.1 The Participant hereby releases, waives, and discharges the Provider, its officers, employees, agents, and affiliates from any claims, liabilities, demands, or causes of action arising out of or related to the Participant's involvement in the Activity.
2.2 This waiver includes claims based on negligence, except for those resulting from gross negligence or willful misconduct by the Provider.
3. Indemnification
The Participant agrees to indemnify and hold harmless the Provider from any claims, costs, or expenses (including legal fees) arising out of their participation in the Activity.
4. Medical Treatment
4.1 The Participant authorizes the Provider to arrange for medical treatment if necessary during the Activity.
4.2 The Participant agrees to bear any costs associated with such medical treatment.
5. Governing Law
This Agreement shall be governed by and construed by the laws of [Applicable Jurisdiction].
6. Entire Agreement
This Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes any prior agreements or understandings.
7. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Signature and Acknowledgment
By signing below, the Participant confirms they have read and understood this Agreement and voluntarily agree to its terms.
