360 Deal Contract
THIS Contract made and entered into on this [Insert Date] (the "Effective Date"), by and between [Your Name], hereinafter referred to as the "Manager", having its principal place of business at [Your Company Address] and [Artist Name], hereinafter referred to as the "Artist", having his/her principal place of residence at [Artist Address].
1. TERM AND OPTIONS
The term of this agreement will commence on the Effective Date and continue for an Initial Period of [Term Length], with the Company having the option to extend the term for up to [Number of Extensions] additional periods.
2. RECORDING COMMITMENT AND DELIVERY
The Artist agrees to record and deliver to the Company a minimum of [Number of Albums] albums. Each album shall consist of at least [Number of Tracks] music tracks of satisfactory technical and artistic quality.
3. ROYALTIES AND PAYMENTS
The Company agrees to pay the Artist a royalty of [Royalty Percentage]% of the wholesale selling price of each unit sold, payable on [Payment Frequency]. The payment will be made on the [Payment Date] of each period.
4. COPYRIGHT AND PUBLISHING
The Artist agrees to grant the Company the sole and exclusive right to exploit the Master Recordings and the Performances embodied therein together with the worldwide copyright and all renewals and extensions thereof.
5. PROMOTION AND MARKETING
The Company agrees to use its best efforts to secure the distribution, promotion, and exploitation of the Master Recordings. The costs of marketing and promotion shall be borne by the Company.
6. WARRANTIES AND REPRESENTATIONS
The Artist hereby warrants and represents that the Performances will be original and will not violate any laws or infringe upon or violate the rights of any third parties.
7. TERMINATION
This Agreement may be terminated by either party by giving [Number of Days] days written notice of such termination, delivered in person or by certified mail.
8. GOVERNING LAW
This Agreement shall be governed by and construed following the laws of [Applicable Jurisdiction].
