What are the Elements of an Exclusive Buyer Agency Agreement?

There are usually four key areas of the agent agreement of an exclusive buyer. Based on when the representative tells you to sign it if it’s the first day you appear innocently at Starbucks and has no idea when you’re going to find a house or the day you’re making an offer, some parts can be more relevant than others.

  1. Buyer-Broker Exclusivity

    The buyer appears to agree to only work with the broker and the agent you have chosen. The expectation is that during the timeline of the agreement, you will not be asking another broker to enter into a relationship with you to help you buy a home. Once you agree to this, you promise to pay a fee to that broker if you buy a home during the contract term.   2. Buyer-Broker Contract Term

    You can see on the first page of your exclusive agreement with a buyer’s agent, usually in the first paragraph, the length of time, or word, indicating how long the agreement is in effect. This could include weeks, months, or even years. The word length is negotiable as with most aspects in the real estate industry.

  3. Buyer-Broker Compensation

    The fee is another aspect of the exclusive arrangement with a buyer’s agent. The amounts for all contracts are negotiable. It’s most likely, however, that the seller would ultimately pay the buyer’s agent for getting them an eligible buyer. However, if the seller doesn’t offer your agent a commission, your contract could include a minimum commission amount that you may have to cover.

  4. Property Description

    The final key part of a contract between the purchaser and the agent/broker is a description of what the purchaser is looking for and the price range requested. The clearer you can be upfront on what you’re looking for, the happier you’re going to be. In case you already have a property with which you are under contract, you might even amend the deal to only refer to that property.

Should You Sign a Buyer Agency Agreement?

First, read in detail all of the terms of the contract and determine how serious you are about finding your dream home. Chances are the person you’re talking to would not send you their full effort, attention, or time of day if you chose not to sign. You cannot blame them for that. Because agents work on a 100 percent contract, it is more than anything else a security issue for them. This is supposing they still choose to work with you.

You can consider it this way- whether you want someone to take the best interest in it, you probably should consider signing it. When you call up the selling agent, they’re going to help you, but probably in the best interest of the seller in mind. You would want to know that in this phase someone is watching out for you, and that agent wants to know that you are loyal to them as well in the form of an agency arrangement for the buyer.

How to Terminate a Buyer Agency Agreement?

Often you know that the relationship just doesn’t work after you sign on with an agent. This is a reason to consider moving on if you believe your agent is not doing enough on your behalf.

The job of a buyer’s agent includes a lot more than just simply writing an offer for you. A buyer agent can help you permit your priorities for a home, identify some prospective homes, recommend the lenders and help you understand the value in one home or another. They also represent your interests throughout the transaction.

There can be many buyer-agent agreements that come to a two-way guarantee that will allow either the agent or the buyer to be set free from the agreement. You should be able to terminate the agreement with a letter of cancellation or termination in most cases.   1. Making the Agreement Short

In case you are not sure that this agent is a good fit for you or you are seriously committed to your home buying search, you may consider the short term.

  2. Request for a Test Trial

    Make sure you ask for a trial run or whether you can spend an afternoon with this person. You can also ask whether they really have your best interest at heart and if they will drive you around and show you a few spots first. How would you sign a deal with someone before you know how diligently they’ll help you? You should feel comfortable to be your agent committing to them.

  3. Read the Important Points

    Make sure you read and do the negotiations with the terms of the buyer agency agreement. After doing this, you can sign the agreement if you want someone to best represent your interests and you are serious about purchasing the help of the agent.
