Entertainment Contract

ENTERTAINMENT CONTRACT

This Entertainment Contract ("Contract") is entered into as of [Date], by and between [YOUR COMPANY Name], located at [YOUR COMPANY Address] ("Employer"), and [Artist/Band Name], with a mailing address of [Artist Address] ("Artist"), collectively referred to as the "Parties."

1. Scope of Agreement

1.1 Performance Details

The artist agrees to perform a live music show at The Grand Concert Hall, on May 15, 2024, with performance(s) commencing at 8:00 PM and concluding at 10:00 PM.

1.2 Technical Requirements

Employer agrees to provide, at no cost to the Artist, all necessary technical support, including sound and lighting equipment.

2. Compensation

2.1 Fee

Employer agrees to pay Artist a total fee of $5,000 for the performance(s), payable as follows: 50% deposit upon signing, balance due on the day of the performance.

2.2 Expenses

Employer shall reimburse Artist for reasonable and pre-approved travel and accommodation expenses,

3. Cancellation

3.1 By Employer

In the event of cancellation by Employer more than 30 days before the performance date, Employer agrees to pay Artist 50% of the agreed fee. If cancellation occurs less than 30 days before the performance, the Employer agrees to pay the full agreed fee.

3.2 By Artist

The artist must provide notice of cancellation at least 30 days before the performance date. In such cases, any deposit paid shall be refunded to the Employer within 14 days.

4. Rights and Permissions

Recording and Merchandising: The artist grants the Employer the right to record the performance for archival and promotional use only. Any commercial use is prohibited unless separately agreed upon in writing. The artist retains the right to sell merchandise at the venue and shall retain all proceeds from such sales.

5. Indemnification

Each Party agrees to indemnify and hold the other harmless from any claims, damages, or expenses arising from their respective breaches of this Contract or negligence.

6. Force Majeure

Neither Party shall be liable for failure to perform its obligations under this Contract if such failure is caused by an act of God, war, government regulation, disaster, strikes (other than strikes by the performing Party's employees), or other emergency making it illegal or impossible to perform their obligations.

7. Entire Agreement

This Contract contains the entire agreement between the Parties regarding the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the Parties.

8. Amendment

This Contract may only be amended or modified by a written instrument executed by both the Employer and the Artist.

9. Governing Law

This Contract shall be governed by and construed under the laws of the [Jurisdiction, e.g., State of New York], without giving effect to any choice or conflict of law provision or rule.
