I. Introduction
This Applicant's Certification Release of Liability ("Release") is a legally binding document between [Your Name], hereinafter referred to as the "Releasor," and the undersigned participant [Applicant's Name], hereinafter referred to as the "Participant," about the Applicant's participation in the Summer Camp Program, hereinafter referred to as the "Activity." By signing this Release, the Applicant acknowledges and agrees to the terms and conditions outlined herein.
II. Acknowledgment of Risks
The Applicant acknowledges that participation in the Activity carries certain inherent risks and dangers, including but not limited to:
Physical injury, including but not limited to bruises, sprains, fractures, and concussions.
Property damage, including damage to personal belongings or equipment.
Emotional distress or trauma.
Other unforeseen hazards or risks associated with the nature of the Activity.
The Applicant understands that these risks may result from various factors, including but not limited to, the condition of facilities, equipment malfunction, the actions or omissions of other participants, or the negligence of the Organization's staff, volunteers, or representatives.
III. Consent & Waiver
By signing this Release, the Applicant voluntarily assumes all risks associated with participation in the Activity. The Applicant hereby releases, discharges, and holds harmless the Organization, its officers, directors, employees, agents, volunteers, and representatives from any claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, sustained by the Applicant while participating in the Activity.
The Applicant acknowledges that this Release constitutes a waiver of liability, and agrees not to hold the Organization liable for any injuries, damages, or losses arising from participation in the Activity, whether caused by negligence or otherwise.
IV. Indemnification
The party applying, henceforth referred to as the Applicant, agrees, acknowledges, and conforms to the requirement to indemnify, which implies the guarantee to compensate for any harm, and hold harmless the Organization, which means absolving the Organization from any blame or liability. This agreement pertains to any allegations of misconduct, liabilities, or legal responsibilities that may surface directly or indirectly out of the Applicant's involvement in the Activity.
This encompasses but is not exclusively limited to, potential claims initiated by third-party individuals or entities. Third parties constitute those who might find themselves sustaining injuries, suffering damages, or encountering any form of harm that can be attributed to the Applicant's direct or indirect actions, lack of action, neglect, or failure to fulfill responsibilities during the Activity.
V. Acknowledgment
The Applicant acknowledges that they have read and fully understand the terms and conditions of this Release.
