How to institute the policy

While this may be a touchy subject to some of your employees, it is still something that you have to do in order to create a drug-free environment within the workplace. There are some circumstances in the workplace that warrant the use of drug testing, and these should be all listed down in the business policy that you are going to create.

  • Job applicants. This is to prevent possible drug pushers or users from becoming employees of your professional company. It would be a wise move for you to wait until the person becomes a candidate for the position before administering a drug test. This can also be done on current employees who are trying to earn a business promotion
  • Post-accident. If you are suspicious of an incident response in the workplace which revolves around alcohol or drugs, then testing everyone involved in the incident should help clear you and your company of sample legal responsibility. Just make sure that your policy properly spells out who is going to be tested.
  • Random employee testing. This is not just something that you surprise the employee with. From the moment that the employee signs an employment contract with your company, you also have to let him or her sign a drug testing consent form which states that he or she consents to random drug testing. You should also state in your policy that there is a one in three chance that the employee will be picked for the testing.

Protocol for your drug and alcohol policy

The next step should be to focus on the protocol for approaching and reporting those employees who may be suspected of violating the general policy. One of the best ways to start is to sit down and talk to the employee and ask questions such as, “Do you have a medical condition or disability that causes you to exhibit these characteristics?” If the employee says yes, then it is best that you ask for supporting documents such as a medical certificate to prove the veracity of his or her response. If the answer is no, then proceed with the plan for testing.

Deciding on the disciplinary action

If an employee were to fail the test, a majority of employers would immediately consider employee termination on the spot. However, there are some employers who opt to help these employees by sending them to drug or alcohol rehabilitation general programs and allowing them to return to work upon completion. Ultimately, it is up to you to decide on the best course of action.
