Free Gym Indemnity Agreement

This Indemnity Agreement ("Agreement") is entered into as of [Date], by and between [Your Company Name], located at [Your Company Address] ("Gym"), and [Participant Name], residing at [Participant Address] ("Participant").

WHEREAS, Participant desires to use the facilities and services provided by Gym, and Gym is willing to permit Participant to use such facilities and services subject to the terms and conditions set forth herein;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

I. Release and Indemnification

A. Release of Liability: Participant hereby releases Gym from any and all liability for any injuries, damages, or losses arising from or related to Participant's use of Gym facilities or participation in Gym activities.

B. Indemnification: Participant agrees to indemnify and hold harmless Gym, its owners, employees, agents, and representatives from and against any and all claims, demands, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or related to Participant's use of Gym facilities or participation in Gym activities.

C. Scope of Indemnity: This indemnification shall include, but is not limited to, claims of negligence, personal injury, property damage, and breach of contract.

II. Assumption of Risk

A. Acknowledgment of Risks: Participant acknowledges that the use of Gym facilities and participation in Gym activities involve inherent risks, including but not limited to the risk of injury, illness, or death.

B. Voluntary Participation: Participant voluntarily assumes all risks associated with using Gym facilities and participating in Gym activities, and agrees that such participation is entirely at Participant's own risk.

C. Understanding of Risks: Participant acknowledges that Gym has made no representations or warranties regarding the safety or suitability of Gym facilities or activities, and understands the risks involved.

III. Insurance

A. Participant's Insurance: Participant acknowledges that it is their sole responsibility to maintain adequate personal health and accident insurance coverage to cover any injuries or damages that may occur while using Gym facilities or participating in Gym activities.

B. Gym's Insurance: Gym agrees to maintain general liability insurance coverage with limits of not less than $[amount] per occurrence and $[amount] in the aggregate, and agrees to provide proof of insurance upon request by Participant.

IV. Miscellaneous Provisions

A. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of laws principles.

B. Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
