Free Release Waiver and Hold Harmless Agreement

This Release Waiver and Hold Harmless Agreement ("Agreement") is made and entered into on this 6th day of January 2050, by and between:

1. ACKNOWLEDGMENT OF RISKS

The Releasor acknowledges and understands that participation in the outdoor activity of rock climbing organized by the Releasee involves inherent risks, including but not limited to falls, equipment failure, exposure to weather, and injury from sharp objects, and that such risks could result in injury, harm, or death.

2. RELEASE OF LIABILITY

In consideration for being allowed to participate in the above-mentioned activity, the Releasor, on behalf of themselves and their heirs, assigns, and personal representatives, does hereby fully and forever release and discharge the Releasee, its officers, employees, agents, affiliates, and representatives from any claims, demands, actions, causes of action, damages, costs, and expenses arising from or related to the Releasor's participation in the activity, including but not limited to those caused by the negligence or willful misconduct of the Releasee.

3. INDEMNIFICATION

The Releasor agrees to indemnify, defend, and hold harmless the Releasee from any claims, demands, actions, suits, damages, liabilities, costs, and expenses, including attorneys' fees, that arise from the Releasor's participation in the activity, including claims arising from the negligence or willful misconduct of the Releasee, to the fullest extent permitted by law.

4. MEDICAL TREATMENT

In the event of an injury or medical emergency, the Releasor authorizes the Releasee to secure medical treatment for the Releasor and agrees to assume full responsibility for all related medical costs.

5. NO WARRANTIES

The Releasor understands that the Releasee makes no warranties or representations regarding the safety, adequacy, or appropriateness of the activity or the facilities used in connection with it.

6. SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

7. GOVERNING LAW

This Agreement shall be governed by and construed by the laws of the state of Illinois, without regard to its conflicts of law principles.

8. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral, relating to such subject matter.
