Construction Management Contract
This Construction Management Contract ("Contract") is entered into on the 22nd day of March 2050, by and between: [Owner's Name], with a mailing address of [Owner's Address], hereinafter referred to as the "Owner", and [Your Company Name], with a mailing address of [Your Company Address], hereinafter referred to as the "Construction Manager".
1. Scope of Work
2. Responsibilities of the Construction Manager
The Construction Manager agrees to perform the services outlined in the Scope of Work with due diligence, and professionalism, and by industry standards and applicable laws and regulations.
The Construction Manager shall provide regular updates and reports to the Owner regarding project status, including any issues or delays encountered and proposed solutions.
The Construction Manager shall exercise reasonable care and skill in the selection and supervision of subcontractors and vendors to ensure the quality and timely completion of work.
The Construction Manager shall maintain appropriate insurance coverage, including but not limited to liability insurance, workers' compensation insurance, and professional indemnity insurance, throughout the project.
3. Responsibilities of the Owner
The Owner agrees to provide the Construction Manager with access to the project site and necessary project-related information promptly.
The Owner shall promptly review and approve project plans, specifications, and change orders as required.
The Owner shall make payments to the Construction Manager by the payment schedule outlined in Section 5 of this Contract.
The Owner shall promptly notify the Construction Manager of any changes to project requirements, scope, or timeline that may impact the performance of the Construction Manager's duties.
4. Compensation:
In consideration of the services provided by the Construction Manager, the Owner agrees to pay the Construction Manager a fee of $50,000 for the duration of the project, payable as follows:
25% upon signing of this Contract
25% upon completion of foundation work
25% upon completion of framing
25% upon completion and inspection
The Owner shall reimburse the Construction Manager for any reasonable and documented expenses incurred in the performance of the services outlined in this Contract, subject to prior approval by the Owner.
5. Term and Termination
This Contract shall commence on the 1st day of April 2050 and shall continue until the completion of the construction project, unless earlier terminated as provided herein.
Either party may terminate this Contract upon written notice to the other party in the event of a material breach of any provision of this Contract by the other party, subject to a cure period of 30 days.
In the event of termination, the Owner shall pay the Construction Manager for all services rendered up to the date of termination, as well as any reimbursable expenses incurred by the Construction Manager before termination.
