Parking Area Rental Agreement
This Parking Area Rental Agreement (the "Agreement") is entered into and made effective as of May 8, 2050 (the "Effective Date") by and between:
1. Parties
Landlord: Davion Barton, residing at San Diego, CA 92101, ("Landlord").
Tenant: Malcolm Raynor, residing at Fresno, CA 93701, ("Tenant").
2. Purpose
The purpose of this Agreement is to establish the terms and conditions by which the Tenant shall rent a parking area owned by the Landlord.
3. Parking Area Description
The Landlord agrees to rent to the Tenant the parking area located at San Diego, CA 92101, which is assigned as Parking Space No. 120 (the "Parking Area").
4. Term
This Agreement will commence on May 10, 2050 and will continue until October 10, 2050, unless terminated earlier pursuant to the terms of this Agreement.
5. Rental Payment
The Tenant agrees to pay the Landlord a monthly rental fee of $800, payable in advance on the first day of each calendar month throughout the term of this Agreement.
6. Use of Parking Area
The Parking Area shall be used solely for parking a single private vehicle. The Tenant shall not use the Parking Area for any other purposes without the Landlord’s prior written consent.
7. Maintenance and Repairs
The Tenant agrees to keep the Parking Area in a clean and orderly condition. The Tenant shall promptly notify the Landlord of any needed repairs or maintenance. The Landlord shall be responsible for the cost and execution of such repairs or maintenance unless otherwise caused by the Tenant's misuse or negligence.
8. Termination
Either party may terminate this Agreement by providing a 30 days' written notice to the other party. Upon termination, the Tenant agrees to vacate the Parking Area and remove any vehicle(s) or personal property.
9. Liability
The Tenant acknowledges and agrees that the Landlord shall not be liable for any loss, damage, or theft of the vehicle or any personal property left in the vehicle or within the Parking Area.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes any prior or contemporaneous oral or written agreements or understandings.
