Free Gym Fitness Agreement

RECITALS

WHEREAS, the Client desires to engage the Gym for the purpose of utilizing its fitness services and facilities;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Membership and Services

1.1 Membership Enrollment

The Client agrees to enroll as a member of the Gym. Membership entitles the Client to access the Gym's facilities and participate in the services specified in this Agreement.

1.2 Services Provided

The Gym agrees to provide the following services to the Client:

• Access to Gym Facilities: Unlimited use of gym equipment and facilities during operating hours.

• Group Fitness Classes: Participation in group fitness classes offered by the Gym, including yoga, spin, HIIT, and others as scheduled.

• Personal Training: Availability of personal training sessions with certified trainers.

• Nutritional Counseling: Access to nutritional guidance and planning services.

• Wellness Programs: Participation in wellness programs and workshops offered by the Gym.

1.3 Membership Types and Fees

2. Term and Termination

• Conduct: Respectful behavior towards staff and other members.

3.2 Medical Clearance

The Client represents and warrants that they have obtained medical clearance from a healthcare professional to participate in fitness activities. The Client agrees to inform the Gym of any medical conditions or limitations that may affect their ability to safely use the Gym's facilities and services.

3.3 Personal Conduct

The Client agrees to conduct themselves in a respectful and responsible manner while on Gym premises. This includes:

• Refraining from the use of inappropriate language or behavior.

• Respecting the privacy and personal space of other members.

• Reporting any damaged equipment or safety hazards to Gym staff immediately.

4. Liability and Indemnity

4.1 Waiver of Liability

The Client acknowledges that participation in fitness activities involves inherent risks, including the risk of injury. The Client agrees to assume all risks associated with their use of the Gym's facilities and participation in its services. The Client hereby waives and releases the Gym, its owners, employees, and agents from any and all claims, liabilities, and damages arising out of the Client's use of the Gym's facilities and services.

4.2 Indemnity

The Client agrees to indemnify and hold harmless the Gym, its owners, employees, and agents from any and all claims, liabilities, damages, and expenses arising out of the Client's use of the Gym's facilities and services, or any breach of this Agreement by the Client.

5. Confidentiality

5.1 Confidential Information

The Client acknowledges that during the course of their membership, they may have access to confidential information concerning the Gym's business, operations, and other proprietary information. The Client agrees to keep all such information confidential and not to disclose it to any third party without the Gym's prior written consent.

5.2 Return of Materials

Upon termination of this Agreement, the Client agrees to return all property, documents, and materials belonging to the Gym, including any confidential information in the Client’s possession.

6. Dispute Resolution

6.1 Arbitration

Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
