I. Agreement Overview

II. Scope of Work

5. Weed Control

   5.1 Identify and treat weeds using appropriate herbicides or organic methods.

   5.2 Maintain a weed-free environment in all lawn areas.

B. Garden Bed Maintenance

1. Weeding

   1.1 Regularly inspect and remove weeds from all garden beds to prevent competition for nutrients.

   1.2 Utilize mulch to suppress weed growth effectively.

2. Mulching

   2.1 Apply mulch to all garden beds twice per year—spring and fall—to conserve moisture and suppress weeds.

   2.2 Use organic mulch such as wood chips, bark, or straw, ensuring a depth of 2-3 inches.

3. Pruning and Trimming

   3.1 Prune shrubs and flowering plants to encourage healthy growth and flowering.

   3.2 Trim perennials after flowering to promote new growth and maintain aesthetics.

4. Plant Health Monitoring

   4.1 Regularly assess the health of plants for signs of disease or pests.

   4.2 Provide recommendations for treatments or replacements when necessary.

C. Tree Care

1. Pruning

   1.1 Prune and trim trees up to a height of 12 feet to ensure proper growth and safety.

   1.2 Remove any dead, diseased, or crossing branches to promote healthy tree structure.

2. Health Assessments

   2.1 Conduct annual inspections of trees to assess overall health and identify potential issues.

3. Removal Services

   3.1 Remove and dispose of any small trees or dead branches as required.

D. Seasonal Services

1. Spring Cleanup

   1.2 Inspect all plants and turf areas for damage or disease.

2. Fall Cleanup

   2.1 Remove fallen leaves, branches, and debris to maintain a tidy landscape.

   2.2 Prepare plants for winter by mulching and protecting delicate plants.

3. Snow Removal

   3.1 Provide snow removal services for pathways, driveways, and parking areas during winter months as needed.

   3.2 Ensure all surfaces are cleared to provide safe access for the Client and their visitors.

III. Service Schedule

A. Regular Services

1. Frequency

   • Services will be provided on a weekly basis during the months of April to November for regular lawn maintenance.

   • Seasonal services, such as snow removal, will be provided as needed.

2. Schedule Notification

   • The Service Provider will provide a service schedule to the Client, detailing the dates and times services will be performed.

   • Any changes to the schedule will be communicated to the Client at least [48 hours] in advance.

B. Additional Services

1. Requesting Additional Services

   • The Client may request additional services outside the scope of this Agreement.

   • All additional services will be billed separately and must be agreed upon in writing by both parties.

IV. Payment Terms

A. Fees

1. Total Fee

2. Payment Structure

B. Client Responsibilities

   • The Client agrees to hold the Service Provider harmless from any claims, damages, or injuries that occur due to pre-existing conditions on the Client's property, such as uneven terrain or hazardous materials.

   • The Client is responsible for informing the Service Provider of any known hazards on the property before work begins.

VII. Dispute Resolution

A. Informal Resolution

1. Initial Discussions

   • In the event of a dispute between the parties arising from this Agreement, both parties agree to first attempt to resolve the issue through informal discussions.

   • Each party will designate a representative to handle dispute discussions.

B. Formal Resolution

1. Mediation

   • If the dispute cannot be resolved informally, it shall be submitted to mediation in accordance with the rules of Local Mediation Association.

   • The mediation will take place within [30] days of the written request for mediation.

2. Arbitration
