1. BACKGROUND
Party A is the organizer of the event/activity (the "Event") and Party B desires to participate in the Event, which will take place on the ___ day of ________, 20. Party B understands that the Event may carry inherent risks and dangers, which may result in injury or damage to the participant or their property.
2. WAIVER AND RELEASE
Party B agrees, for themselves, their heirs, executors, administrators, and assigns, to fully waive, release, and discharge Party A, its officers, employees, agents, and volunteers from any and all claims, demands, actions, or causes of action, including personal injury, death, property damage, or loss, arising from or related to Party B's participation in the Event, regardless of whether such claims are caused by the negligence of Party A.
3. ASSUMPTION OF RISK
Party B acknowledges that participation in the Event involves certain risks, including, but not limited to, physical injury, illness, or even death. By signing this Agreement, Party B affirms that they voluntarily assume all risks associated with their participation, whether foreseen or unforeseen.
4. MEDICAL RELEASE
Party B grants permission for Party A to seek emergency medical treatment if necessary in case of injury or medical emergency. Party B understands that they are responsible for any medical costs incurred as a result of such treatment.
5. INDEMNIFICATION
Party B agrees to indemnify and hold harmless Party A from any claims, losses, or damages that may arise from their actions, omissions, or negligence while participating in the Event.
6. GOVERNING LAW
This Agreement shall be governed by, and construed by, the laws of the state of __________ (insert relevant jurisdiction). Any disputes arising from this Agreement shall be resolved in the courts of that jurisdiction.
7. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties concerning the Event and supersedes all prior agreements or understandings, oral or written, concerning the subject matter of this Agreement.
8. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
9. ACKNOWLEDGMENT
By signing below, Party B acknowledges that they have read, understood, and voluntarily agree to the terms and conditions outlined in this Waiver Agreement.
