Real Estate Broker Agreement
This Real Estate Broker Agreement (hereinafter referred to as the "Agreement") is entered into as of 15th of November, 2050 (the “Effective Date”), by and between Morgan Ben, an individual residing at 4321 Edington Drive, Atlanta, GA 30303 (hereinafter referred to as the "Client"), and Teng Realty, a real estate brokerage company duly incorporated under the laws of the state, with its principal place of business at 2220 Sweetwood Drive, Atlanta, GA 30303 (hereinafter referred to as the "Broker"). Both parties shall hereinafter collectively be referred to as the "Parties".
1. Scope of Services
The Broker agrees to provide services to the Client in relation to the sale of real property located at 32 Sigley Road (the “Property”). Services shall include but are not limited to, marketing the Property, conducting property viewings, communicating with potential buyers, and negotiating the sale price.
2. Broker's Fee
In consideration of the Broker’s services, the Client agrees to pay a commission fee determined at the close of the sale of the Property. Such fee shall be calculated as a percentage of the total sale price.
3. Obligations of the Parties
The Parties hereby agree to conduct themselves with full commitment, maintain confidentiality about details of discussions concerning this brokerage services, and agree not to act in such a way as to harm the interests of the other.
4. Terms of the Agreement
The term of this Agreement shall commence on the Effective Date and continue until the 15th of November, 2051 unless terminated earlier in accordance with the provisions herein.
5. Termination
Either Party may terminate this Agreement with written notice, within the provisions laid forth in this Agreement, subject to any legal and/or contractual obligations.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state.
7. Dispute Resolution
Any dispute arising out of or in connection with this Agreement shall be addressed via discussion between the Parties. If a resolution cannot be reached, the matter shall be settled through arbitration or court proceedings
8. Entire Agreement
This Agreement contains the complete understanding and agreement of the Parties and supersedes all prior representations, warranties, and agreements, whether oral or written, with respect to the subject matter hereof.
9. Amendments
This Agreement may only be amended in writing and signed by both Parties.
10. Assignment
Neither Party shall assign any of its rights or obligations under this Agreement without the prior written consent of the other Party.
IN WITNESS WHEREOF, the Parties hereto, intending to be legally bound, have duly executed this Real Estate Broker Agreement as of the Effective Date.
