7 Steps for Creating an Employee Contract

Step 1: Identify the Parties Involved

Every contract should point out the names of the individuals or businesses that are willing to form a contract with one another. In this case, it should be one that points out which party is the employer and which is the employee. Be sure that their complete names and roles are written properly into the contract.

Step 2: Explain the Benefit and Consideration

The contract must be able to point out what either party is willing to give up in exchange for something else. Basically, an employment contract should state what position the employee is going to attain and what he/she is expected to do while he/she is employed under the company.

Step 3: Specify the Duration of the Contract

If you want the contract to only last for a certain period of time, then you are going to have to be very specific by stating the exact date in which it will end. If not, then you can point out that the other party’s employment will continue so long as he/she adheres to the terms and policies of the company.

Step 4: Provide Details on the Employee’s Duties

This is where the employee will see what it is that he/she will be doing while under contract. Provide clear explanations for every single duty and responsibility that the employee has and you have to make sure that these are in line with the position.

Step 5: Explain Details Concerning Compensation

Here is where you will share how the employee’s compensation will be calculated in a manner that’s equal to the service that he/she provides. This is also where you can include information such as the payment schedule or the method in which the employee will receive his/her pay.

Step 6: Share the Benefits

The contract should provide information on the benefits that the other party will receive from the company should he/she officially become an employee. This is where you will provide benefits such as insurance, allowances, or anything that the company is willing to offer.

Step 7: Include Any Miscellaneous Provisions

Before finishing the contract, you will want to add anything that can potentially protect the company. It is here where you can include confidentialities, warranties, breach of contract, severability, etc.
